Procedure for Offering the LNG Terminal on an Open Season Basis 2020


 

Between 23 March and 29 May 2020, Polskie LNG (now GAZ-SYSTEM) conducted market consultations on the 2020 LNG Terminal Open Season Procedure. It enabled market participants to submit binding bids for the provision of regasification services and additional services provided by the President Lech Kaczyński LNG Terminal in Świnoujście.

SUPPLEMENTARY INFORMATION UNDER THE OPEN SEASON PROCEDURE FOR THE LNG 2020 TERMINAL

Polskie LNG S.A. (currently GAZ-SYSTEM), responding to the need to provide potential Terminal users with complete information for the purpose of calculating tariff rates for services provided as part of the Basic Regasification Service, Additional Services and the Transition Service, presents a tariff calculator based on verified assumptions and data currently held by Polskie LNG S.A (currently GAZ-SYSTEM).

Presentation of the new tariff calculator does not imply any change to Annex no. 5 to the 2020 LNG Terminal Open Season Procedure. Publication of the calculator is for information purposes only and does not require the User interested in submitting an offer to make any changes to the offer, including recalculation of the bank guarantee. 

The amount of the bank guarantee should still be determined on the basis of indicative tariff rates for the use of the Basic Regasification Service, Additional Services and the Transition Service contained in the tariff calculator published on the day of launching the Procedure for Offering the LNG Terminal on an Open Season Basis 2020, i.e. on 23 March 2020, which forms Attachment no. 5 to this Procedure. 

We would like to inform again that the information presented by Polskie LNG S.A. (currently GAZ-SYSTEM) in the newly published calculator, as well as in Annex no. 5, the tariffs for services provided under the Basic Regasification Service, Additional Services or Transition Services are indicative and are aimed solely at estimating the forecasted fees for making the Terminal capacity available.

UPDATE OF THE SCHEDULE FOR THE LNG 2020 TERMINAL RELEASE PROCEDURE

In accordance with para. 9.3. of the 2020 Procedure for Offering an LNG Terminal on an Open Season Basis, Polskie LNG S.A. (currently GAZ-SYSTEM) changed the schedule of this procedure by extending the deadlines for submitting the bid (until May 21) and thus for the announcement of the results (May 22) as well as for the signing of the regasification agreements (May 29). Taking into account the change of schedule, Polskie LNG S.A.  (currently GAZ-SYSTEM) made the appropriate changes to the Rules of the 2020 Procedure for Offering an LNG Terminal on an Open Season Basis and to Annex no. 3 to the Procedure - Model Bank Guarantee. At the same time, the OFFER FORM, which the Participant of the Procedure was obliged to submit within the deadline specified in the Schedule, was made more precise.

UPDATE OF THE SCHEDULE FOR THE LNG 2020 TERMINAL RELEASE PROCEDURE

In accordance with para. 9.3. of the 2020 Procedure for Offering an LNG Terminal on an Open Season Basis, Polskie LNG S.A. (currently GAZ-SYSTEM) changed the schedule of this procedure by extending the deadlines for submitting the Offer (until 11 May), announcing the results (until 15 May) and signing the Regasification Agreements (until 22 May).

Moreover, Polskie LNG S.A. (currently GAZ-SYSTEM) introduced several additional amendments to the 2020 Procedure for Offering an LNG Terminal on an Open Season Basis, the Regasification Agreement and the attachments to these documents in order to clarify the provisions contained therein. In particular, this concerns provisions relating to the bank guarantee, which the Participant of the Procedure is obliged to submit when submitting its Offer and maintain during the execution of the Regasification Agreement.

Procedure for Offering the LNG Terminal on an Open Season Basis 2020

Polskie LNG S.A. (now GAZ-SYSTEM), owner and operator of the President Lech Kaczyński LNG Terminal informed about the launch of the 2020 Procedure for Offering an LNG Terminal on an Open Season Basis, which enabled market participants to submit binding bids for the provision of regasification services and additional services.

The purpose of the 2020 Procedure for Offering an LNG Terminal on an Open Season Basis was to conclude Regasification Agreements in connection with the Terminal Expansion Program on market, equal and transparent terms for all interested gas fuel market participants.

As a result of the 2020 Procedure for Offering an LNG Terminal on an Open Season Basis, services will be allocated that provide:

  • maximisation of revenues generated by Polskie LNG (currently GAZ-SYSTEM), which promotes efficient investment in LNG infrastructure;
  • creating a mechanism for maximum and safe use of available LNG infrastructure;
  • increase in liquidity of the gas fuel market and the development of competition.

The rules of participation in the Procedure are described in the "Regulations for the Procedure for Offering an LNG Terminal in Świnoujście on an Open Season Basis 2020".

Open Season Procedure for the Expansion Program

Consultation on the Rules of Procedure for Offering an LNG Terminal on an Open Season Basis 2020

Polskie LNG S.A. (currently GAZ-SYSTEM), owner and operator of the President Lech Kaczyński LNG Terminal, planned to carry out the 2020 Procedure for Offering an LNG Terminal on an Open Season Basis, which enabled collecting bids for providing regasification services and additional services.

The purpose of the 2020 Procedure for Offering an LNG Terminal on an Open Season Basis was to conclude Regasification Agreements in connection with the Terminal Expansion Program on market, equal and transparent terms for all interested gas fuel market participants. As a result of the 2020 Procedure for Offering an LNG Terminal on an Open Season Basis, services will be allocated that provide:

All interested market participants were invited to submit their comments and remarks concerning both the Regulation and the procedure as a whole no later than 12 March 2020, 17:00 (CET).

As part of the market consultations, market participants were able to send written comments and questions on the Open Season Procedure for the LNG Terminal in Świnoujście 2020 to Polskie LNG S.A. (currently GAZ-SYSTEM).

Having completed the consultation stage, Polskie LNG S.A. (currently GAZ-SYSTEM) evaluated and summarized the comments gathered during the consultation and will revise the Rules of the Open Season Procedure for the LNG Terminal in Świnoujście in 2020 accordingly.

Changes to the attached working documents will be introduced based on information obtained during this consultation and as a result of further work on draft documents conducted by Polskie LNG S.A. (currently GAZ-SYSTEM)

Polskie LNG S.A. (now GAZ-SYSTEM) undertakes to analyse all information obtained during the consultation with due diligence, but reserves the right to include some and omit other information at its own discretion.

 

 

 

INFORMACJA DODATKOWA W RAMACH PROCEDURY UDOSTĘPNIENIA TERMINALU LNG 2020

Polskie LNG S.A. (obecnie GAZ-SYSTEM), odpowiadając na potrzebę przekazywania potencjalnym użytkownikom Terminalu pełnych informacji w celu wyliczenia stawek taryfowych za usługi świadczone w ramach Podstawowej Usługi  Regazyfikacji, Usług Dodatkowych oraz Usługi Przejściowej, przedstawia kalkulator taryfowy, oparty o zweryfikowane założenia oraz aktualnie posiadane przez Polskie LNG S.A. (obecnie GAZ-SYSTEM) dane.

Przedstawienie nowego kalkulatora taryfowego nie oznacza zmiany załącznika nr 5 do Procedury Udostępnienia Terminalu LNG 2020. Publikacja kalkulatora ma charakter wyłącznie informacyjny i nie wymaga od Użytkownika zainteresowanego złożeniem oferty żadnych zmian w zakresie oferty, w tym przede wszystkim ponownego przeliczenia gwarancji bankowej. 

Wysokość gwarancji bankowej nadal winna zostać ustalona na podstawie indykatywnych stawek taryf z tytułu korzystania z Podstawowej Usługi Regazyfikacji, Usług Dodatkowych i Usługi Przejściowej zawartych w kalkulatorze taryfowym opublikowanym w dniu uruchomienia Procedury Udostępnienia Terminalu LNG 2020, tj. w dniu 23 marca 2020 r., który stanowi załącznik nr. 5 do tej Procedury. 

Przy czym ponownie informujemy, że przedstawiane przez Polskie LNG S.A. (obecnie GAZ-SYSTEM) w nowo opublikowanym kalkulatorze, jak też w załączniku nr 5 taryfy za usługi świadczone w ramach Podstawowej Usługi  Regazyfikacji, Usług Dodatkowych lub Usługi Przejściowej są  indykatywne i mają jedynie na celu oszacowanie prognozowanych opłat za udostępnienie zdolności Terminalu.

AKTUALIZACJA HARMONOGRAMU PROCEDURY UDOSTĘPNIENIA TERMINALU LNG 2020

Zgodnie pkt. 9.3. Procedury Udostępnienia Terminalu 2020 Polskie LNG S.A. (obecnie GAZ-SYSTEM) dokonało zmiany harmonogramu tej procedury poprzez wydłużenie terminów na złożenie oferty (do 21 maja), a tym samym ogłoszenia wyników (22 maja) oraz podpisania umów na regazyfikację (29 maja). Mając na uwadze zmianę harmonogramu Polskie LNG S.A. (obecnie GAZ-SYSTEM) wprowadziło właściwe zmiany do treści Regulaminu Procedury Udostępnienia Terminalu 2020 oraz do Załącznika nr 3 do Procedury – Wzór Gwarancji Bankowej. Jednocześnie dokonano doprecyzowania FORMULARZA OFERTOWEGO, który Uczestnik Procedury był zobowiązany przedłożyć w terminie określonym w Harmonogramie.

AKTUALIZACJA HARMONOGRAMU PROCEDURY UDOSTĘPNIENIA TERMINALU LNG 2020

Zgodnie pkt. 9.3. Procedury Udostępnienia Terminalu 2020 Polskie LNG S.A. (obecnie GAZ-SYSTEM) dokonała zmiany harmonogramu tej procedury poprzez wydłużenie terminów na złożenie Oferty (do 11 maja), ogłoszenia wyników (do 15 maja) oraz podpisania Umów o Regazyfikację (do 22 maja).

Ponadto Polskie LNG S.A. (obecnie GAZ-SYSTEM) wprowadziło kilka dodatkowych zmian treści Procedury Udostępnienia Terminalu 2020, Umowy o Regazyfikację oraz załączników do tych dokumentów, mających na celu doprecyzowaniu postanowień zawartych w tych dokumentach. W szczególności dotyczy to postanowień odnoszących się do gwarancji bankowej, którą Uczestnik Procedury jest zobowiązany przedłożyć przy złożeniu Oferty oraz utrzymywać w trakcie realizacji Umowy o Regazyfikację.

(currently GAZ-SYSTEM) introduced several additional amendments to the 2020 Procedure for Offering an LNG Terminal on an Open Season Basis, the Regasification Agreement and the attachments to these documents in order to clarify the provisions contained therein. In particular, this concerns provisions relating to the bank guarantee, which the Participant of the Procedure is obliged to submit when submitting its Offer and maintain during the execution of the Regasification Agreement.

Procedure for Offering the LNG Terminal on an Open Season Basis 2020

Polskie LNG S.A. (now GAZ-SYSTEM), owner and operator of the President Lech Kaczyński LNG Terminal informed about the launch of the 2020 Procedure for Offering an LNG Terminal on an Open Season Basis, which enabled market participants to submit binding bids for the provision of regasification services and additional services.

The purpose of the 2020 Procedure for Offering an LNG Terminal on an Open Season Basis was to conclude Regasification Agreements in connection with the Terminal Expansion Program on market, equal and transparent terms for all interested gas fuel market participants.

As a result of the 2020 Procedure for Offering an LNG Terminal on an Open Season Basis, services will be allocated that provide:

  • maximisation of revenues generated by Polskie LNG (currently GAZ-SYSTEM), which promotes efficient investment in LNG infrastructure;
  • creating a mechanism for maximum and safe use of available LNG infrastructure;
  • increase in liquidity of the gas fuel market and the development of competition.

The rules of participation in the Procedure are described in the "Regulations for the Procedure for Offering an LNG Terminal in Świnoujście on an Open Season Basis 2020".

REGISTRATION

Between 23 March and 30 March until 5:00 p.m., Market Participants interested in participating in the Procedure could submit to Polskie LNG (currently GAZ-SYSTEM) a correctly filled out Registration Form together with the documents referred to in item 4.1.2 of the Regulations, in writing to the following address: Al. Jerozolimskie 146, Building B, 02-305 Warsaw and send a scan of these documents by e-mail to the following address: OpenSeason@polskielng.pl

OFFER

By 20 April 2020 till 5:00 p.m., Participants could submit an Offer to Polskie LNG (currently GAZ-SYSTEM) using the form available on the website of Polskie LNG (currently GAZ-SYSTEM).  Participants will submit the Offers in writing to the following address:  Al. Open Season Procedure for the Expansion Program

Consultation on the Rules of Procedure for Offering an LNG Terminal on an Open Season Basis 2020

Polskie LNG S.A. (currently GAZ-SYSTEM), owner and operator of the President Lech Kaczyński LNG Terminal, planned to carry out the 2020 Procedure for Offering an LNG Terminal on an Open Season Basis, which enabled collecting bids for providing regasification services and additional services.

The purpose of the 2020 Procedure for Offering an LNG Terminal on an Open Season Basis was to conclude Regasification Agreements in connection with the Terminal Expansion Program on market, equal and transparent terms for all interested gas fuel market participants. As a result of the 2020 Procedure for Offering an LNG Terminal on an Open Season Basis, services will be allocated that provide:

Polskie LNG SA (currently GAZ-SYSTEM) submitted for consultation with market participants interested in the LNG Terminal Expansion Program the draft "Regulations of the Open Season Procedure for the LNG Terminal in Świnoujście 2020".

All interested market participants were invited to submit their comments and remarks concerning both the Regulation and the procedure as a whole no later than 12 March 2020, 17:00 (CET).

As part of the market consultations, market participants were able to send written comments and questions on the Open Season Procedure for the LNG Terminal in Świnoujście 2020 to Polskie LNG S.A. (currently GAZ-SYSTEM).

Having completed the consultation stage, Polskie LNG S.A. (currently GAZ-SYSTEM) evaluated and summarized the comments gathered during the consultation and will revise the Rules of the Open Season Procedure for the LNG Terminal in Świnoujście in 2020 accordingly.
